FOR US FESTIVAL

For Us Festival, powered by the Fit For Us creative agency, is committed to centering, and celebrating the experiences of marginalized groups.
For Us Festival serves as a catalyst to actualizing Fit For Us' commitment to overturning health disparities, and inequalities while simultaneously continuing to center, and celebrate the joy and brilliance within our culture.
For Us Festival is committed to creating and scaling brave and safe spaces for members of the body positive/plus sized community, LGBTQIA+ community, creative & entrepreneur community, art and music lovers, birthing bodies, Black and Brown people, and anyone who is committed to supporting health equity.
For Us Festival maintains the right to restrict or reject any person whose presence has come to impact others negatively at the event. Any acts of perceived violence and or aggression, will result in removal from the space.Illegal substances are strictly prohibited at the Festival. Any person found in possession of such substances will be denied entry and / or removed from the Festival, and Police may be called to attend.
To ensure the safety of all festival attendees, access to the event sites will be refused to, but not limited to, people who:
are under the influence of illegal drugs or any other illegal substances
are clearly suffering from alcohol or other substance intoxication
have been previously banned from festivals and/or other events by the organizer, the administration or legal authorities
are demonstrating an intent to disturb the peace or to provoke someone else to do so
engage in fighting or any disruptive behavior
resist the direction of and searches by the Festival’s security guards
CONDUCT. I acknowledge that the FOR US FESTIVAL reserves the right to restrict or prevent my participation at the Event in the Location at any time in the event that FOR US FESTIVAL staff, including, but not limited to their representatives and/or security reasonably determine that my behavior is unsafe or objectionable to FOR US FESTIVAL, or participants in the Event, in FOR US FESTIVAL’s absolute discretion. I understand that in FOR US FESTIVAL or its designees’, sole discretion, I may be removed from the Event or any of the Services for any reason, in FOR US FESTIVAL or their designees’ sole discretion.
Tickets
Cancellations, Refunds, Exchanges: Tickets to this event are final sale and cannot be refunded, transferred, or exchanged. Before purchasing tickets, it is Attendee’s responsibility to carefully review all aspects of the Event, Event restrictions, dates, location, and pricing. For Us Festival will NOT issue any refunds or exchanges because Attendee failed to review this information and For Us Festival will not issue any refunds for any lost, stolen, destroyed, or damaged tickets, or as under any other circumstances except in the limited cases explicitly described in this Agreement.
Our authorized ticket supplier is Tock. Tock’s terms of service can be found here.
Tickets purchased from unauthorized sales channels or third parties may be forged, and in this case would not be honored or eligible for a refund. If you do choose to purchase from a third party, you assume full responsibility for ensuring your ticket is valid.
Restrictions: This ticket is a revocable license and breach of these terms will terminate Attendee’s license to attend the Event without refund. For Us Festival reserves the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct is deemed disorderly, who uses vulgar or abusive language or who fails to comply with the For Us Festival rules. Attendee and Attendee’s belongings may be required to be searched on entry to Event.
Entry:
Once you purchase your ticket you will receive an order confirmation email from Tock on behalf of For Us Festival. You will scan your mobile ticket in exchange for your wristband at Check In upon arriving at the Festival. You will not be allowed to enter any festival events unless wearing your own, valid wristband. Festival wristbands must be worn at all times and must not be tampered with. Tampering with your wristband may deem it void and result in you being removed from the festival or required to purchase a new ticket.
There will be no automatic right of re-admission during the Festival should the wristband become lost, stolen, destroyed or damaged and you unconditionally accept the risk of damage to, loss of and/or theft of your band. Your wristband is not redeemable for cash.
Anyone caught forging entry tickets, wristbands or any other special admission tickets in order to access the Festival or sell such tickets for the festival will be prosecuted without exception.
PARKING
For Us Festival disclaims all responsibility from losses or damages to vehicles parked in or near the For Us Festival . For Us Festival l is not responsible for losses or damage to any vehicle on or near the For Us Festival, including, without limitation, vehicles towed from the Festival site.
VALUABLES AND PERSONAL PROPERTY. I acknowledge that neither the FOR US FESTIVAL, the Releasees, nor any of their respective officers, directors, managers, partners, agents, employees, stockholders, representatives, members, and vendors and each of their respective related, affiliated and subsidiary entities, successors, licensees, and assigns shall be liable for the loss of or theft of, or damage to, my personal property.
PHOTO/VIDEO POLICY
Photography and Video: Attendee consents to written, audio, photographic, and video recording (“Recordings”). Attendee agrees that For Us Festival shall be the sole and exclusive owner of all rights, titles, and interests to all the results and proceeds of all Recordings, including all copyrights, trademarks, trade secrets, moral rights, and other intellectual property rights. Attendee grants the For Us Festival the exclusive, perpetual, irrevocable, and unrestricted rights to use, publish, reproduce, distribute, license, and sell the Recordings, in whole or in part, in any manner, and Attendee’s likeness, voice, name, image, and biography in connection with the Recordings. For Us Festival shall have the right to edit and/or transcribe the Recordings. Attendee waives the right to inspect or approve use of these Recordings.Any artwork or performances sponsored by the Festival or taking place on Festival grounds is also subject to a mandatory, non-exclusive license to For Us Festival for use in promotional purposes.
Attendee hereby releases, defends, indemnifies and holds harmless For Us Festival, officers, employees or agents from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution.The “Footage” may also be used by or on behalf of the For Us Festival or any of the For Us Festival subsidiaries, affiliates, partners, sponsors, officers, shareholders, successors or assigns for any purpose, including, but not limited to, archival, promotional, and commercial purposes, without any compensation to you. You waive all other rights in the Footage, including, but not limited to, all claims of so-called moral rights. This Footage may also be used as a means to identify and facilitate the prosecution of illegal or impermissible conduct.
The parties hereby release, discharge and agree to hold harmless each other, their respective agents, employees, legal representatives and assigns, and all other persons acting other either’s permission or authority, including without limitation any claims.
Attendees may take photos and shoot video for personal, non-commercial use with personal cameras. Any recordings made by ticket holders on or near the Festival site may not be used for commercial or public purposes, unless consented to by the Company. DRONE use is prohibited.
Force Majeure: For Us Festival shall not be liable or responsible to Attendee, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in performance when and to the extent such failure or delay is caused by or results from acts or circumstances beyond their reasonable control, including, without limitation, acts of God; fire; flood; natural disaster or emergency; hurricane; tornado; severe storm; earthquake; act of war, invasion or hostilities (whether war is declared or not); sabotage; explosions; government actions; terrorist threats or acts; revolution or insurrection; riot or civil unrest; epidemic or pandemic; lockouts, strikes or other labor disputes (whether or not relating to For Us Festival or For Us Festival’s workforce); interruption or failure of utility or telecommunications service (for example, Internet failures); or failure of suppliers, subcontractors, and carriers to substantially meet their performance obligations.
Assumption of Risk: Attendee has voluntarily applied to participate in For Us Festival (“Event”). Attendee is voluntarily participating with the knowledge of the numerous risks and dangers involved, which include but are not limited to: dangers and risks inherent in the festival; negligence in any manner on the part of For Us Festival; emotional trauma; accidents; illness; allergic reactions; disfigurement; technology failures; business losses; economic losses; temporary or permanent disability, including paralysis; death; acts of God; violence or criminal acts of others; unsafe conditions; the dangers of civil disturbances and war; forces of nature; transportation failures; equipment failures; accident or illness in places without access to medical facilities, transportation, or means of evacuation and assistance; unexpected events; terrorist activities, social or labor unrest; mechanical or construction failures or difficulties; diseases; local laws; climatic or weather conditions; abnormal conditions or developments; or any other actions, omissions, or conditions outside of For Us Festival’s control.
Attendee also hereby consents, gives authorization to, and releases from liability all staff to secure any emergency medical treatment in the event Attendee is unable to, and Attendee agrees to be responsible for the costs thereof.
ATTENDEE AGREES THAT THE TERMS OF THIS AGREEMENT SHALL SERVE AS A COMPLETE RELEASE AND EXPRESS ASSUMPTION OF RISK for Attendee, and their heirs, successors, assigns, and legal representatives. It is Attendee’s intention to fully assume all risks associated with the Event and to release For Us Festival from any and all liability to the maximum extent permitted by law.
LIMITATION OF LIABILITY:
IN NO EVENT SHALL THE For Us Festival HAVE ANY LIABILITY TO ATTENDEE FOR ANY LOST PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, MULTIPLE, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES HOWEVER CAUSED AND, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY, WHETHER OR NOT THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE; AND IN NO EVENT SHALL THE For Us Festival’S LIABILITY EXCEED THE FEES PAID UNDER THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR UNDER ANY OTHER THEORY OF LIABILITY. THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
MEDICAL CARE
In the event of a medical emergency, you hereby consent to medical care and transportation at your cost in order to obtain treatment that is deemed reasonably appropriate or necessary by the reasonable discretion of the For Us Festival staff, security, police or medical professionals.
MEDICAL RELEASE
I acknowledge and agree that participating in and attending the Event subjects me to the risk of physical illness or injury (minimal, serious, catastrophic and / or death) and that I acknowledge that I am assuming the entire risk of such illness or injury by attending the Event and participating in the Activities. In the event of such illness or injury, I authorize the FOR US FESTIVAL and any of the Releasees to obtain necessary medical treatment for me and hereby release and hold harmless all of the Releasees in the exercise of this authority. I further acknowledge and understand that I will be responsible for any and all medical and related bills that may be incurred by me for any illness or injury that I may sustain in connection with the Services and while traveling to and from the site for the Services whether or not the Services are actually rendered and will be required to Indemnify all of the Releasees as set forth in this Release.
GOVERNING LAW;WAVIER OF JURY TRIAL
This Release shall be deemed to be an executory agreement entered into in the State of California and shall be governed by and interpreted in accordance with the laws of the State of California applicable to agreements made and to be fully performed in California without regard to any choice of law principles or statutes thereof. Any legal proceeding arising out of and/or in connection with this Release, the Event, the Activities or the Services, shall be submitted to the exclusive jurisdiction of the Courts of Los Angeles County, California and I hereby waive any defenses or objections based on lack of jurisdiction, improper venue and/or forum non conveniens. THE PARTIES HEREBY WAIVE TRIAL BY JURY WITH RESPECT TO ANY SUCH ACTION OR PROCEEDING. 7. PARTICIPATION RULES. I agree to abide by any and all rules, regulations, and schedules of the FOR US FESTIVAL, which may be posted or distributed at or prior to the Event, whether distributed by e-mail, or issued orally, all of which, I acknowledge and agree may be amended from time to time in the FOR US FESTIVAL's sole and absolute discretion.
INDEMNIFICATION
You further expressly agree to indemnify and hold harmless FOR US FESTIVAL, Releasees and Releasees’ members, managers, principals, officers, directors, successors, assigns, executors and administrators against loss from any claims, demands or actions that may subsequently be brought by me or by any other persons on the account of damages, costs, expenses, liabilities or other losses of any character resulting to me in any way from, in connection with, or as a consequence of, any and all activities associated or connected in any way with the Services and while traveling to and from the Location, in each of the foregoing cases whether or not the Services are actually rendered in full or in part. I further agree to reimburse and to make good to Releasees any loss, damages, or costs Releasees may have to pay as a result of any such action, claim, or demand, including but not limited to attorneys’ fees. I understand that the foregoing waivers and indemnities are a material inducement to the FOR US FESTIVAL to allow me to receive the Services and participate in the Event and the Activities, that the FOR US FESTIVAL is expressly relying on such waivers and indemnities in allowing me to participate in the Event and Activities and receive the Services, and that, but for such waivers and indemnities, I would not be permitted to receive the Services or participate in the Event or the Activities.
ENTIRE AGREEMENT
This Release contains the entire understanding of the Parties hereto with respect to the subject matter hereof and supersede all prior agreements and understandings relating to the subject matter hereof. Moreover, I acknowledge that this Release supersedes any prior or contemporaneous agreements and statements, whether written or oral, concerning such rights, and that in the event of any conflict between this Release and any other document pertaining to such rights, this Release shall control.
LITIGATION
I agree that neither I nor my heirs, executors, administrators, personal representatives and/or anyone else claiming on my behalf, shall institute any suit or action at law or otherwise, or assist in the prosecution, of any claims against any of the Releasees. I hereby so instruct my heirs, executors, administrators, personal representatives and/or anyone else claiming on My behalf. In the event of any dispute or litigation between the Parties relating to or arising out of this Release, the prevailing party shall be entitled to an award of reasonable attorneys’ fees and costs at the pretrial, trial and appellate levels.
I CERTIFY THAT I HAVE READ THIS RELEASE AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
VALIDITY OF WAIVER
I acknowledge and agree that this Release will be used by the FOR US FESTIVAL and all holders, sponsors and organizers of the Activities, Services and Event covered under this Release and that this Release will govern my actions and responsibilities in connection with my participation therein. I further acknowledge and agree that if I institute, or anyone on my behalf institutes, any claims against any of Releasees, this Release can and will be used as evidence in court, and that releases like this one have been upheld in courts in similar circumstances.
DISCLAIMER AND ACKNOWLEDGEMENT
I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS RELEASE IN ITS ENTIRETY AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I AM AWARE THAT THIS RELEASE RELEASES THE FOR US FESTIVAL AND ALL OF THE RELEASEES FROM LIABILITY RELATED TO THE SERVICES, ACTIVITIES AND EVENT AND CONTAINS AN ACKNOWLEDGEMENT OF MY VOLUNTARY AND KNOWING ASSUMPTION OF THE RISK OF INJURY OR ILLNESS FROM PARTICIPATION IN THE EVENT OR ANY OF THE ACTIVITIES AT THE LOCATION. I FURTHER ACKNOWLEDGE THAT NOTHING IN THIS RELEASE CONSTITUTES A GUARANTEE THAT THE SERVICES WILL BE FULLY OR PARTIALLY RENDERED AND THAT THERE IS THE RISK THAT THE EVENT AND/OR ACTIVITIES MAY BE CANCELLED BY THE FOR US FESTIVAL, IN THEIR SOLE DISCRETION, AND NOT RESCHEDULED. I ACKNOWLEDGE THAT ALL TICKET SALES ARE FINAL, AND NO REFUNDS, CANCELLATIONS OR EXCHANGES CAN BE MADE, NOR IS THE NAME ON THE ORIGINAL TICKET TRANSFERRABLE. ADDITIONALLY, I ACKNOWLEDGE THAT DUE TO TIME CONSTRAINTS AND/OR CAPACITY LIMITATIONS, I MAY NOT BE ABLE TO PARTICIPATE IN ALL OR ANY OF THE SERVICES. I HAVE SIGNED THIS DOCUMENT VOLUNTARILY AND OF MY OWN FREE WILL. I UNDERSTAND THAT I AM WAIVING ANY RIGHT THAT I MAY HAVE TO BRING A LEGAL ACTION TO ASSERT A CLAIM AGAINST FOR US FESTIVAL, RELEASEES, OR EITHER OF ITS/THEIR AGENTS RELATING TO THE SERVICES AND PARTICIPATION IN THE EVENT AND THE ACTIVITIES. I HEREBY CERTIFY AND REPRESENT THAT I HAVE READ THE FOREGOING AND FULLY UNDERSTAND THE MEANING AND EFFECT THEREOF AND, INTENDING TO BE LEGALLY BOUND, I HAVE SIGNED THIS RELEASE ON THE DATE SET FORTH BELOW. I HEREBY GIVE MY EXPRESS CONSENT TO THE EXECUTION OF THIS RELEASE, AND I WILL NOT REVOKE MY CONSENT.
